ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 17.03.2022 for the offences punishable under Sections 294(b), 307 & 506(2) of IPC @ 302 of IPC in crime No.90 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 16.03.2022 at about 08.30 p.m., there was a quarrel between the defacto complainant's brother and their father, therefore the defacto complainant rushed to the place and comprised the issue. Again at 1.00 p.m., they started to fight and at that time, the defacto complainant's brother stabbed their father with button knife in his stomach and escaped from that place. Thereafter, the defacto complainant admitted him in the hospital. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he seeks for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Additional Public Prosecutor would submit that the petitioner is the single accused and he attacked his father due to property dispute with knife and caused injuries, thereby he died. Hence, he vehemently opposed to grant bail to the petitioner.
5. The deceased is none other than his own father. Due to property dispute, the petitioner attacked his own father with iron rod and as such, he sustained injuries and died. The petitioner is being son, that too for property, he killed his own father. Therefore, this Court is not inclined to grant bail to the petitioner.
