ORDER
This writ petition has been filed challenging the impugned notice issued by the 1 st respondent dated 04.04.2025, directing the petitioner to produce all the original documents at the time of survey to be conducted on 09.04.2025. 2.Heard Ms.V.Revathy, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of 1 st respondent.
3.The main grievance expressed by the learned counsel for the petitioner is that the survey is sought to be conducted based on the earlier order passed by this Court in W.P.No.33407 of 2024 dated 18.11.2024. The learned counsel submitted that this Court had specifically directed the respondents to conduct an enquiry and to take a decision and whereas, without even conducting an enquiry, a survey is sought to be conducted on 09.04.2025. 3/5 further submitted that there is already a pending suit between the parties and even without disclosing the same, the 3 rd respondent has managed to get a direction in the above writ petition.
4.The learned Additional Government Pleader appearing on behalf of the st respondent submitted that the 1 st respondent will conduct an enquiry based on the objections given by the petitioner and pass an order. Without conducting an enquiry, the survey will not be conducted by the 1 st respondent.
