ORDER

The petitioner, who was arrested and remanded to judicial custody on 18.11.2025 for the alleged offences under Section 64(2)(m) of B.N.S. read with

Section 5(m) and 6(1) of POCSO Act altered as Sections 75(1)(i) read with 75(2) of B.N.S. and Section 9(l), (n) read with 10 of POCSO Act and Section 75 of J.J. Act in Cr. No.39 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, who is a step father of the victim girl, has molested the minor victim girl. Hence, this case.

3. There is no representation on the side of the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police would submit that the petitioner is aged about 35 years and the victim girl is a minor. The earlier application was dismissed on 25.03.2026 and there is no change in circumstances and hence prays to dismiss the petition.

5. While perusing the earlier order passed by this Court on 25.03.2026, it is seen that the petitioner is none other than the step father of the victim girl. In the said order dated 25.03.2026 passed in Crl O.P. No.7546 of 2026, in Para No.6, this Court observed as follows:- "6. From the submissions made by the learned counsel on either side, though the petitioner has been incarcerated since 18.11.2025, as rightly pointed out by the learned Government Advocate (Crl. Side), considering the relationship of the victim girl with the petitioner qua step father, if the petitioner is enlarged on bail, then it will create mental trauma on the victim girl and apart from that it will also jeopardise the trial proceedings. Hence, this Criminal Original Petition is dismissed".

7. After the dismissal of the above said petition, there is no substantial change in circumstances and therefore, this Court is of the view that this petition is liable to be dismissed.

8. Accordingly, this Criminal Original Petition is dismissed. 20-04-2026 MJS Note:
