In these two miscellaneous applications, the petitioners have filed writ petitions aggrieved by the fact that even though they were successful in the preliminary examination, at the time of main examination, when they download the hall ticket, which was uploaded in the internet that the certificates, which were uploaded by them with reference to the teaching experience were not acceptable by the respondents and they are treated as open market candidates.
2. At that stage, an interim order has been granted by this Court to permit the petitioners to write the main examination in respect of the Post viz., District Educational Officer. Accordingly, both the writ petitioners wrote the main examination.
3. Now, on 30.04.2024, the respondents are proceeding further with the oral test. Therefore, whether the writ petitioners would be within the zone of consideration, considering them under the teaching category or not is the the question, which has to be decided in the writ petitions. 1/4
4. Mr.Abrar Md. Abdullah, learned Standing Counsel appearing on behalf of the TNPSC would submit that, it is the stand of the TNPSC that the respondent TNPSC is not satisfied with the certificate uploaded by the petitioners, so as to consider them for the post under the Aided school.
5. Be that as it may, as on date, the counter affidavit has not yet been filed, so as to decide the main writ petition.
6. In that view of the matter, when this Court already permitted the petitioners to write the main examination by provisionally treating them eligible as Aided school teachers, the respondent TNPSC shall permit both the petitioners to participate in the oral examination also and accordingly, evaluate them and keep their selection in a sealed cover. The respondent TNPSC shall also file counter in both the writ petitions.
7. Upon final decision in the writ petitions, the results in respect of both the writ petitioners can be declared and accordingly, if they are within the zone of consideration and if this Court comes to the conclusion that they are entitled to the post as aided teachers, they can be given appointment.
