This petition is filed by the petitioner seeking to condone the delay of 60 days in filing the above Revision against M.C.No.118/2022 passed by the first respondent.

2.Heard both sides. As rightly pointed by the learned counsel for the petitioner, the impugned order cannot be sustained in view of the judgment passed by the Division Bench of this Court vide Order dated 13.03.2023 passed in Cr.R.C.Nos.137/2018 etc. Thus, the impugned order is set aside.

3. Accordingly, this petition is ordered. Registry is directed to number the petition immediately, if is otherwise in order.
