ORDER

The petitioner joined as a Constable with the respondent/Central Reserve Police Force on 01.06.1977. It appears that the petitioner was transferred to the Jammu and Kashmir in 2006 and therefore the petitioner requested for re-consideration of the aforesaid transfer order. It also appears that the petitioner had approached this Court in W.P.No.14197 of 2007 challenging the aforesaid transfer order. The said Writ Petition appears to have dismissed with certain direction.

2. Under these circumstances, the petitioner opted for VRS and was thus allowed to retire from service pre-maturely on 01.10.2007. It is the case of the petitioner that the respondents have deliberately not given the Service Record, Pension Book and ID Card. 2/5

The learned Senior Panel Central Government Standing Counsel for the respondents submits that these documents i.e., Service Record, ID Card and together with Tag were sent to the petitioner by RPAD. However, the petitioner has refused to receive the same. It is further submitted that as far as the pension book is concerned, unless the petitioner furnishes the documents stated at Sl.Nos.3, 4, 6 and 7 and the other documents stipulated in the impugned order dated 11.06.2016, pension of the petitioner cannot be processed. There is no justification in not handing over the ID and the Service Records to the petitioner.

4. Today, the aforesaid documents have been produced before this Court. The ID Card and the Service Record of the petitioner is directed to be handed over to the petitioner, forthwith immediately on any day during the month of May. The respondents are directed to clear the arrears of pension and to regularise the pension, which has not been paid and regularised earlier. The petitioner is at liberty to work out the other remedies, if any, in the manner known to law. 3/5

5. This Writ Petition stands disposed of with the above liberty. No costs.
