Writ Appeal as against the order dated 22.02.2019 in W.P.No. 4955 of 2019.
W.P.No.4955 of 2019:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the Ist Respondent to select and appoint the petitioner to the post of Human Resource Executive in the 1st Respondent and consequently for bearing the respondents from filling up the vacancy to the
post of Human Resource Executive called for pursuant to the recruitment advertisement dated July, 2018.

Mr.R.Neelakandan for Mr.K.Ramesh J U D G M E NT (Judgment of the Court was delivered by K.K. SASIDHARAN,J.) The appellant without challenging the selection made by the Oil and Natural Gas Corporation to the post of Human Resource Executive filed the writ petition for a simple mandamus to consider his candidature and appoint him to the post of Human Resource Executive. The writ petition was dismissed by order dated 22 February, 2019. Feeling aggrieved, he has come up with the present intra-court appeal.
When the appeal is taken up for admission today, the learned counsel for the appellant fairly submitted that the appellant ought to have challenged the final results published by the Oil and Natural Gas Corporation. The learned counsel therefore seeks liberty to withdraw this writ appeal and challenge the final results published by the Oil and Natural Gas Corporation.
Since Oil and Natural Gas Corporation has already published the results, there is no question of issuing a mandamus. Now that the appellant has realised the incorrect prayer made in the writ petition, we are of the view that he should be given liberty to challenge the final results published by the Oil and Natural Gas Commission.
