Writ petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondent to issue a Patta pertaining to property bearing Plot No.R-1 Part, New Plot No.R-1 B, having an extent of 1260 sq.ft out of 2520 sq.ft comprised in S.No.745/1, situated at Madambakkam Village, "S.R.Colony", Tambaram Taluk, Kancheepuram District.

Mr.S.Navaneethan, learned Additional Government Pleader takes notice for the respondent. By consent of the parties, the main writ petition itself is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a Mandamus directing the respondent to issue a Patta pertaining to the property bearing Plot No.R-1 Part, New Plot No.R-1 B, having an extent of 1260 sq.ft out of 2520 sq.ft comprised in S.No.745/1, situated at Madambakkam Village, "S.R.Colony", Tambaram Taluk, Kancheepuram District.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent.

4. The grievance of the petitioner is that his request for granting patta made as early as on 10.11.2014, has not been considered by the respondent so far.

5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the respondent to consider and decide the same, in accordance with law. Therefore, without expressing any view on the merits of the matter, this writ petition is disposed of, only with a direction to the respondent to consider the request of the petitioner to grant Patta in respect of the subject matter property and pass orders on merits and in accordance with law, also after considering the rival claimants, if any. Such exercise shall be done by the respondent within a period of four weeks from the date of receipt of a copy of this order. No costs.
