WMP.No.13297 of 2024 in WP.No.33667 of 2017 DR D.NAGARJUN,J This writ miscellaneous petition is filed to permit the petitioner to withdraw the amount of Rs.15,21,320/- (Rupees Fifteen Lakhs Twenty One Thousand Three Hundred Twenty Only) and Rs.27,15,499/- (Rupees Twenty Seven Lakhs Fifteen Thousand Four Hundred and Nienty Nine Only) that has been deposited by the petitioner on January 24, 2018 in favour of the Registrar General High Court Madras as per the order of this Honourable Court dated December 22 2017 including interest if any.

Heard learned counsel for the petitioner and learned counsel for the respondent, as per the directions of this Court dated 22.12.2017, the petitioner has deposited amount of Rs.15,21,320/- (Rupees Fifteen Lakhs Twenty One Thousand Three Hundred Twenty Only) and Rs.27,15,499/- (Rupees Twenty Seven Lakhs Fifteen Thousand Four Hundred and Ninety Nine Only) in favour of respondent Nos.2 & 3 respectively vide two different cheques dated 24.01.2018 in WP.No.33667 of 2017.

3. During the pendency of this writ petition, the matter was send for mediation and in the mediation, the issue involved was settled between both the parties. The copy of the settlement arrived at before the mediator, is filed. 1/4

4. The petitioner and respondent Nos.2 and 3 have entered into two agreements, one on 05.04.2024 and the other on 18.04.2024. As per, one of the said agreements at paragraph No.5 an amount of Rs.15,21,320/- deposited in this Court by the petitioner vide cheque No.875470 dated 24.01.2018 in favour of in favour of the Registrar General Madras High Court be released in favour of Nat West Digital Services India Private Limited for which respondents shall extend all the co-operation. Similarly basing on another settlement dated 05.04.2024 at paragraph No.5, it is agreed that an amount of Rs.27,15,499/- deposited in this Court by Nat West Digital Services India Private Limited vide cheque No.875469 dated 24.01.2018 in favour of Registrar General of Madras High Court be released in favour of Nat West Digital Services India Private Limited for which respondent shall extend all co-operation.

5. Now the learned counsel representing the respondent Nos.2 and 3 had endoresed on this petition that respondent Nos.2 and 3 have no objection if the said amounts so deposited are released in favour of the petitioner and the same is recorded.

6. Accordingly, this writ miscellaneous petition is allowed, permitting the petitioner to withdraw the amount of Rs.15,21,320/- (Rupees Fifteen Lakhs Twenty One Thousand Three Hundred Twenty Only) and 2/4

Rs.27,15,499/- (Rupees Twenty Seven Lakhs Fifteen Thousand Four Hundred and Nienty Nine Only) that has been deposited by the petitioner on January 24, 2018 in favour of the Registrar General High Court Madras as per the order of this Honourable Court dated December 22 2017 including the accrued interest if any. The Registry is directed to carryout these directions after properly verifying the records and after identifying the parties to whom cheques have to be given, by following the procedure for issuance of cheques.

7. Registry is directed to carry out necessary amendments in the cause title as per the order of this Court in WMP.No.13295 of 2024. 29.04.2024 nst DR D.NAGARJUN,J.
