A.No.2660 of 2022 in C.S.No.384 of 2020 KRISHNAN RAMASAMY, J., This Application has been filed by the applicants/defendants 6 & 7 seeking to set aside the ex-parte order dated 28.04.2022 passed in CS.No.384 of 2020.

2.The learned counsel appearing for the applicants/defendants 6 & 7 would submit that this Court while allowing the impleading application filed by the applicants herein, directed the respondents 1 to 3 to file the amended copy of the plaint and also directed the applicants herein to file the written statement within 10 days. Since the respondents 1 to 3/plaintiffs has not served the copy of the amended plaint, the applicants/defendants 6 & 7 could not file the written statement in time and hence, the learned counsel seeks to set aside the ex-parte order. 1/2 https://www.mhc.tn.gov.in/judis

3.The learned counsel appearing for the respondents 1 to 3/plaintiffs submitted that the respondents 1 to 3/plaintiffs have no objection in allowing the present application. 4.Considering the submission made by the learned counsel appearing for the applicants/defendants 6 & 7 and in the interest of the justice, this Court feels it appropriate to set aside the ex-parte order. 5.Accordingly, the application is allowed and the ex-parte order dated 28.04.2022 is set aside.
