ORDER

The writ petition is filed seeking to quash the order dated 21.11.2025 passed by the respondent and consequently, direct the respondent to pay the HRA allowance to the petitioner.

2.The short facts of the case are as follows: 2.1.The petitioner would submit that he had joined the services in the respondent office as Sub Inspector and later, promoted as Inspector and thereafter, as the Adjutant Inspector and had attained superannuation on 30.06.2025.

2.2.The petitioner would submit that although he was working as Adjutant Inspector, he was not allotted quarters and he was using a dilapidated building which was allotted as quarters to the employees who are in the Sub Inspector Cadre. The petitioner would submit that he had been requesting for HRA allowance which was not been acceded to and had also given representations to the same. By the impugned order dated 21.11.2025, the request of the petitioner has been turned down. Challenging the same, the petitioner is before this Court.

3.The learned Additional Government Pleader would submit that the petitioner had been illegally occupying the quarters allotted to the Sub Inspector Cadre on a rent free basis and therefore, he cannot demand HRA and it was on this ground that the request of the petitioner was turned down. He would therefore, prays for dismissal of this writ petition by confirming the impugned order.

4.Heard the rival submissions and perused the materials available on record.

5.The petitioner had himself admitted the fact that he was occupying the quarters that has been allotted to the Sub Inspector cadre. The impugned order would clearly show that the quarters had been occupied by the petitioner without any agreement and he has illegally occupied the same using his position as Adjutant Inspector. This came to light when a report has been submitted by the Circle Inspector/Sub Inspector. Therefore, having squatted on the government property, the petitioner cannot claim HRA allowance and I see no reason to interfere with the impugned order.

Accordingly, this Writ petition is dismissed. Connected miscellaneous petition is closed. No costs.
