ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.03.2026 for the alleged offences under Sections 126(2), 296(b), 115(2), 309(4), 311 and 351(3) of B.N.S. in Cr. No.108 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 04.03.2026 at about 9.40 hours, the petitioner along with another accused, waylaid the defacto complainant near Periyakuppam Seashore, robbed a sum of Rs.2,200/- from him and also threatened him with dire consequences, and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner was arrested and remanded to judicial custody on 04.03.2026 and by this time, investigation might have been completed and hence prayed to enlarge the petitioner on bail.

4. At this juncture, the learned Government Advocate (Criminal side) appearing for the respondent police would strongly object the bail application and submitted a list of cases pending against the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. While perusing the list of cases pending against the petitioner, it is seen that this petitioner has 4 previous cases in his credit and among them, two cases are registered under NDPS Act. The very past conduct of the petitioner would show the character of the petitioner qua in repeating the offence without fear of law. Therefore, as rightly contended by the learned Government

Advocate, if the petitioner is enlarged on bail, it may embolden him to do similar act. Hence, this Court is of the firm view that it is not an appropriate stage to consider this bail application.

7. Accordingly, this Criminal Original Petition is dismissed. 09-04-2026 MJS Note:
