ORDER
The petitioner, who was arrested and remanded to judicial custody on 20.01.2026 for the alleged offences under Section 87 of B.N.S. and Sections
5(l), 5(j)(ii) read with Section 6(1) of POCSO Act in Cr. No.1 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 03.11.2025, the petitioner committed aggravated penetrative assault on the victim girl. Hence, this case.
3. The learned counsel appearing for the petitioner would submit that the petitioner has been remanded to judicial custody on 20.01.2026 and he is an innocent. The learned counsel would further submit that the petitioner is ready and willing to abide by any condition that may be imposed by this Court and prayed to enlarge him on bail.
4. However, the learned Government Advocate (Criminal side) appearing for the respondent police submitted the statement of the victim girl, who is aged 15 years, recorded under Section 183 B.N.S.S. and would submit that the allegations against the petitioner are serious in nature.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. While perusing the 183 B.N.S.S. statement of the victim girl, it is seen that there are serious allegations against the petitioner. Therefore, considering
the totality of circumstances and upon the fact that if the petitioner is enlarged on bail, the same would prejudice the prosecution case, hence this Court is not inclined to enlarge the petitioner on bail.
7. Accordingly, this Criminal Original Petition is dismissed. 21-04-2026 MJS Note:
