Respondents Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents herein more particularly 9th respondent herein, directing to re-survey and demarcate the lands in Chinna Kalrayanmalai Village in Pethanaickanpalayam Taluk, Salem District, mentioned in the petitioners representation dated 17.05.2023 and 15.08.2023 by considering the same in accordance with law in the light of Pro.O.Mu.No:11063/2001-3 dated 23.11.2001 of the Assistant Settlement Officer (South), Chennai - 5 issued in favour of similarly placed persons Thiru.Mani S/o. Pitchai, Kattuvellampatty, Punnampatty Village, Natham Taluk, Dindigul District and issue patta in the names of the petitioner and his four sons within a stipulated time frame.

This writ petition is filed for a direction to the 9th respondent to measure the petitioner's land in Chinna Kalrayanmalai Village in Pethanaickanpalayam Taluk, Salem District, by disposing of the petitioner's representations dated 17.05.2023 and 15.08.2023 within a time stipulated by this court.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

3. The case of the petitioner is that the subject property was his ancestral property. It is the grievance of the petitioner that the petitioner has given representations dated 17.05.2003 and 15.08.2023 requesting to re-survey the said property, demarcate its boundaries and to issue patta. However, the same have not been considered by the respondents. Hence, the present Writ Petition.

4. Considering the limited relief sought in this writ petition, the 9th respondent is directed to consider the representations of the petitioner 3/6

dated 17.05.2023 and 15.08.2023 and pass appropriate orders on the petitioner's representations for re-survey of the property and demarcate its boundaries, after giving notice to the neighbouring land owners and any other interested persons, within a period of two months from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. No costs.
