ORDER
This Writ Petition has been filed seeking a direction to the respondents 1 and 2 herein to grant affiliation to the petitioner's institution to start new course for undergraduate for Arts and Science College for impart of education to the locality students.
2. Heard the learned counsels appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

It is the case of the petitioner that the petitioner's Institution was established in the year 1997 and running B.Ed., College by obtaining recognition from the third respondent / NCTE and also by grant of affiliation by the Pondicherry University every year. Thereafter, the petitioner's college obtained No Objection Certificate from the said University for starting new undergraduate courses such as B.A. Tamil, English, B.Sc. Maths, B.Com., B.C.A. Further, the petitioner has applied for affiliation to the respondent University for starting a new undergraduate Arts and Science College for the academic year. Since no order was passed, the petitioner made representations to the respondent University and also filed a Writ Petition before this Court in
W.P.No.25800 of 2022, however the same was dismissed on the ground to approach the National Council for Teacher Education [NCTE] which had granted recognition to run B.Ed Courses and also observed that affiliation can be sought only for the related courses. Challenging the same, the petitioner filed an appeal in W.A.No.2564 of 2023, wherein the Hon'ble Division Bench of this Court had disposed the appeal with the observations that the petitioner shall make a fresh application to the respondent University for affiliation with all relevant documents and also to consider the same on its own merits and also to decide whether the permission of NCTE is necessary or not to run Arts and Science Courses in an institution imparting B.Ed. Course.
The petitioner also made a fresh representation to the respondent University as per the aforesaid direction of the Division Bench and after due process, the respondent University inspected the institution and found some deficiencies and directed the petitioner to rectify the same and the petitioner has also rectified and submitted his report to the respondent University on 04.01.204, however there was no response inspite of several representations. Aggrieved over the same, the present Writ Petition.
4. The learned counsel for the petitioner submitted that as per the directions issued during inspection by the respondent University regarding certain deficiencies/lapses on the petitioner's college, the petitioner has rectified the same and submitted its report of compliance on 04.01.2024 to the
respondent University, however till date, affiliation as well as recognition was not granted to the petitioner's College. He further submitted that there may be a direction to the respondents to consider the petitioner's application of affiliation within a reasonable time and thus, prayed for appropriate orders.

Per contra, the learned counsel for the respondent University submitted that the petitioner's college has committed serious lapses and the same were not rectified as per their directions and hence, the affiliation granted by the respondent University was withdrawn from 2020 onwards. She submitted that the earlier Writ Petitions filed in W.P.Nos.31184 of 2019 & 4416 of 2021 were dismissed on 07.09.2021 and the same was also confirmed by the Division Bench of this Court. She contended that since the defects were not rectified by the petitioner as per the rules of the respondent University, affiliation was not granted to the petitioner and thus, she prayed for dismissal of the Writ Petition.

The learned counsel for the third respondent / NCTE submitted that recognition was denied by the third respondent to the petitioner's college and challenging the same, the petitioner has preferred a petition in W.P.43372 of 2025 but the same was dismissed on 03.12.2025 with liberty to prefer an appeal. He further submitted that he has no instructions in regard to any appeal preferred or recognition was granted to the petitioner's college and hence, prayed for passing appropriate orders.
7. It is seen that the petitioner's college is running B.Ed. Institution and now wanted to start Arts and Science College for which they sought for affiliation from the respondent University. Due to lapse on the part of the petitioner, the respondent University has refused to grant affiliation to start new undergraduate Course College in the petitioner's college. It is also pertinent to note that the petitioner is running B.Ed., course in the said college where it wants to start undergraduate course of Arts and Science for which NCTE has to decide the said issue. Apart from that, the petitioner has not complied with the lapses mentioned by the respondent University during inspection. In this backdrop, this Court is of the view that the relief sought for by the petitioner in this Writ Petition cannot be granted.
8. For the foregoing reasons, the Writ Petition fails and the same stands dismissed. However, liberty is granted to the petitioner to comply with the lapses mentioned by the respondent University and prefer an appeal as directed by this Court as against the withdrawal of the affiliation by the respondents. Consequently, connected Miscellaneous Petition is closed. There shall be no order as to costs.
