A.No.4158 of 2022 A.No.4158 of 2022 in C.S.No.604 of 2019 C.V.KARTHIKEYAN,J., The present application has been filed seeking to set aside an exparte order dated 22.04.2022, setting the defendant in the suit, ex-parte.

2. It had been noted that on that particular date, the defendant has not filed the written statement and therefore the defendant had been set exparte.

3. Now it is represented that the defendant had actually filed the written statement and also had filed Court fees along with the written statement as required in the suit for partition and those applications are pending.

4. The learned counsel for the plaintiffs had stated that he had received the copies.

5. In view of the fact that it is only be appropriate that the parties are heard and opportunity is given before decree is passed in the suit, present application stands allowed.
