[Order of the Court was made by S.S.SUNDAR, J.,] (1)Today, the above writ petition is posted under the caption ''For Being Mentioned'' at the instance of the Court.
(2)This Court, vide order dated 26.02.2024, disposed of the writ petition with a direction to the 4th respondent to refund the amount paid by the petitioner that was deposited towards regularisation fee less the demolition charges to be paid by the petitioner to CMDA. This Court also directed the 4th respondent to pay the demolition charges of Rs.1,06,977/- to CMDA within the stipulated time. (3)However, upon correcting the order, this Court found that the amount payable by the petitioner towards demolition charges, i.e, Rs.1,06,977/-, is more than the amount which has sought to be refunded to the petitioner towards refund of the regularisation fee, i.e, Rs.64,945/-. Hence, this Court directed the Registry to post the above writ petition under the caption ''For Being Mentioned''.
(4)Today, after hearing the learned counsels on either side, this Court is inclined to modify paragraph No.4 of the order dated 26.02.2024. Paragraph No.4 reads thus:- ''4.Hence, the 4th respondent is directed to pay the amount of Rs.64,945/- that was deposited by the petitioner towards regularisation fee to the 1st respondent / CMDA in lieu of the demolition charges that the petitioner is liable to pay to CMDA within a period of two weeks from the date of receipt of a copy of this order. The petitioner is also directed to pay the balance amount of Rs.42,032/- to the 1st respondent / CMDA towards demolition charges within a period of two weeks from the date of receipt of a copy of this order.''
