2. Heard learned counsel for petitioner.

3. Notice has been served on the first respondent and the first respondent is represented through a counsel.

4. Notice sent to the second respondent has been returned with an endorsement 'insufficient address'.

5. Though notice has been served on the third respondent and the name of the third respondent is printed in the cause list, there is no appearance for the third respondent either in person or through a pleader.

6. Satisfied with the reasons assigned in the affidavit filed in support of the petition, this petition is allowed and the delay of 259 days in filing the above appeal is condoned.

Registry is directed to number the appeal, if it is otherwise in order and post it for admission in due course. Registry is also directed to print the name of Mr.G.Adithyaraj, learned counsel for first respondent at the time of admission.
