ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379 and 430 of IPC read with Section 21(5) of Mines and Minerals Act, 1957 in Cr.No.235 of 2022, on the file of the respondent police, seeks anticipatory bail.

2.It is the case of the prosecution that on 20.04.2022 when the respondent police were conducting routing vehicle check up, the accused were found transporting 3 units of Kiln Soil by using 2 Tipper Lorries along with a JCB vehicle. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case since he happens to be the owner of the said JCB. He would further submit that A2 to A4 have been enlarged on anticipatory bail by this Court in Crl.O.P.No.12467 of 2022 by order dated 26.05.2022. 4.The learned Government Advocate (Crl. side) appearing for the respondent submitted there are 10 previous cases against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into account the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original petition is dismissed.
