Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 3rd respondent to inspect the spot and submit report as per the Memo of the 1st respondent dated 19.06.2020 and memo of the 2nd respondent dated 18.06.2020 as per representation dated 23.03.2020.

ORDER

(1)This writ petition has been filed for the issue of a writ of mandamus, directing the 3rd respondent to act upon the representation made by the petitioner and to conduct a spot inspection in the subject property and submit a memo before the 1st respondent in order to enable the 1st respondent to take a decision in accordance with law.

(2)Mr.E.Balamurugan, learned Special Government Pleader accepting notice on behalf of the respondents submitted that the 3rd respondent has fixed the date of enquiry on 24.09.2020 at 11.00 a.m. Learned Special Government Pleader submitted that the petitioner can be present during the enquiry along with all the relevant documents.

(3)Taking into consideration, the facts and circumstances of the case and also of the fact that the 3rd respondent has already fixed the date of enquiry, there shall be a direction to the 3rd respondent to conduct a spot enquiry and submit a report based on the documents furnished by the petitioner to the 1st respondent. This process shall be completed within a period of four weeks from the date of receipt of a copy of this order. (4)This writ petition is disposed of with the above direction. No costs.
