PRAYER: Tr.C.M.P. filed under section 24 of C.P.C., to withdraw the proceedings pending before the Principal District Court, Vellore in I.D.O.P.No.5 of 2015 and transfer the same to the Principal District Court, Thiruvallur, to be tried along with I.D.O.P.No.159 of 2014.

O R D E R

The petitioner filed I.D.O.P.No.159 of 2014, before the Principal District Court, Tiruvallur. The respondent filed a Petition in I.D.O.P.No.5 of 2015, before the Principal District Court, Vellore, praying for a decree under section 32 of the Divorce Act, 1869. The prayer now is to withdraw the proceedings from the file of the Principal District Court, Vellore and transfer the same to the file of Principal District Court, Tiruvallur. 2.Heard the learned counsel appearing for the petitioner and the learned counsel for the respondent. 3.There are two matrimonial proceedings pending before two different Courts. I am, of the view that the Transfer Petition deserves to be allowed, so as to https://hcservices.ecourts.gov.in/hcservices/

enable one of these two Courts to dispose of the proceedings.

4.The proceedings in I.D.O.P.No.5 of 2015, is withdrawn from the file of Principal District Court, Vellore and is transferred to the file of Principal District Court, Tiruvallur, for disposal along with I.D.O.P.No.159 of 2014, on merits.

The Transfer CMP is allowed as indicated above. No costs. Consequently, connected miscellaneous petition is closed.
