ORDER
This application has been filed to condone the delay in filing further documents on the side of the plaintiffs. The documents which are listed are certified copies of Judgment and decree in O.S.No.8569 of 1972 and documents relating to Survey plan of the lands in Ayanavaram. All the documents are certified copies.
2. In the affidavit filed, it had been contended that the documents were not produced at the time of filing of the suit and are now found to be relevant during the course of trial. It had been stated that they were https://www.mhc.tn.gov.in/judis
A No.2561 of 2025 C.V. KARTHIKEYAN,J., vum available in City Civil Court, Chennai and certified copies have to be applied and as soon as they have been obtained, the documents would be produced before the Court.
3. A Counter has been filed stating that the documents were very much available even at the time of filing the suit, but they have been introduced at a belated stage. At any rate, merely filing the documents would not mean that they would be considered by the Court. They would only be considered when they are admissible and they are proved in manner known and are relevant to decide the issues in the suit. The respondents will have that protection.
4. Taking all the facts into consideration, this application stands allowed.
