Tr.C.M.P. filed under section 24 of C.P.C., to withdraw the suit in O.S.No.3575 of 2015 on the file of VII Additional City Civil Court, Chennai and transfer the same to the Principal District Judge, Salem to be tried along with O.S.No.218 of 2014.

O R D E R

Learned counsel for the petitioner submitted that the suit in O.S.No.3575 of 2015 was dismissed for default. In view of the subsequent events, nothing survives for adjudication. Learned counsel therefore seeks permission to withdraw the transfer petition with liberty to file a fresh petition, in the event the suit in O.S.No.3575 of 2015 is restored to file, and made an endorsement to that effect.

2. In view of the endorsement made by the learned counsel for the petitioner, the transfer CMP is dismissed as withdrawn with liberty. No costs. Consequently, connected miscellaneous petition is closed.
