Prayer: Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorari to call for the records of the first respondent in Na.Ka.No. 28929/C3/2017-2, dated 18.08.2017, transferring the petitioner from the Presidency College, Chennai to M.R.Government Arts College, Mannarkudi, Thanjavur District and quash the said impugned order as illegal on the grounds of malafides, victimisation violation of the principles of natural justice. O R D E R

It appears that the petitioner had filed this writ petition challenging the transfer order issued to him. Now the learned counsel for the petitioner submits that in the meanwhile, since the transfer order which was impugned having been modified and the petitioner been posted to nearby places in Chennai, the petitioner does not want to press the writ petition and wants to join in the new place of posting but submits since the petitioner had been absent for such period, respondents be directed to regularise such period of absence by allowing the leave to the petitioner as permissible to him

2. Considering such submissions of the learned counsel for the writ petitioner, the learned counsel for the first respondent would submit that such period of absence of the petitioner shall be considered to be regularised by allowing the leave to the petitioner as permissible to him.

3. Considering the submissions of the learned counsel for the parties, the writ petition stands disposed of as withdrawn with the direction to the respondents to consider regularisation of such period of absence of the petitioner by allowing the leave to the petitioner as permissible to him in accordance with law. Consequently, connected miscellaneous petition is closed. However, in the circumstances there shall be no order as to costs.
