Prayer:- Criminal Original Petitions filed under Section 482 Cr.P.C., to direct the respondent police to register a case based on the petitioner complaint dated 26.07.2016 and also to direct the respondent police to give necessary police protection to the petitioner and her men to proceed with the construction.

O R D E R

This petition has been filed to direct the respondent police to register a case based on the petitioner's complaint dated 26.07.2016 and also to direct the respondent police to give necessary police protection to the petitioner and her men to proceed with the construction.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is represented by the learned Additional Public Prosecutor that on the complaint of the petitioner dated 26.07.2016, the petition enquiry is pending in CSR No.438/2016 before the respondent and the petitioner is not co-operating in the enquiry.

4. In view of the above, the petitioner is directed to appear before the respondent police and co-operate in the enquiry and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [(2014) 4 SCC 1], otherwise, the petition may be closed under intimation to the https://hcservices.ecourts.gov.in/hcservices/

petitioner.

5. As regards the prayer for police protection, the respondent police may enquire into the complaint dated 26.07.2017 by calling all the parties and take action in accordance with law.
