Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of Mandamus directing the 3rd respondent to consider the representation of the petitioner dated 04.10.2013 and pass orders on the same in regard to arrears of salary w.e.f 01.01.2011 onwards based on the order of the District Educational Officer's proceedings dated 15.06.2013. ORDER

The relief sought for in this writ petition is for a direction, directing the 3rd respondent to consider the representation of the petitioner dated 04.10.2013 and pass orders in respect of the arrears of salary.

The learned counsel appearing for the writ petitioner contended that the writ petitioner was initially appointed as 'Night Watchman' in the regular vacancy on Time Scale of Pay through the order of the 2nd respondent dated 27.12.2000.

However, the learned counsel appearing for the petitioner further contended that the claim relating to the salary for the interregnum period has not been considered by the 3rd respondent, more specifically with effect from 01.01.2011 to 16.07.2013 and in this regard, the writ petitioner submitted a representation to the 3rd respondent dated 04.10.2013 and the same is yet to be considered.

Thus, this Court without going into merits and demerits of the case, directs the 3rd respondent to consider the representation submitted by the writ petitioner on 04.10.2013 and pass final order on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.

With these direction, the writ petition stands disposed of. No cost. Consequently, connected miscellaneous petition is also closed.
