Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents. With the consent of either side, this writ petition is taken up for final disposal at the admission stage itself. 2.The petitioner has filed this writ petition seeking issuance of Mandamus directing the respondents to release the Tipper Lorry bearing Registration No.TN-20-AM-8008 seized on 01.08.2015 by the 3rd respondent.
3.Learned counsel for the petitioner would state that the petitioner is innocent and is the owner of the vehicle and he has not committed any illegality. Further, it is submitted that the https://hcservices.ecourts.gov.in/hcservices/
petitioner eke out his livelihood by hiring the above said vehicle and that the petitioner has sent a representation dated 03.08.2015 to the third respondent seeking to release the vehicle and the same is pending.
4.The learned Special Government Pleader appearing for the respondents fairly submitted that the respondents may be directed to consider and dispose of the petitioner's representation within a week's time from the date of receipt of a copy of this order. 5.In the light of the above, without going into the merits of the case, there will be a direction upon the petitioner to send one more representation to the respondents by enclosing a copy of the representation dated 03.08.2015 along with a copy of this order and the respondents on receipt of such representation is directed to consider and dispose of the same and pass orders on merits and in accordance with law within a period of one week from the date of receipt of a copy of this order.
