This miscellaneous petition has been filed to condone the delay of 98 days in filing the appeal.

2. Heard the learned counsel for the petitioner and the learned counsel appearing for the 2nd respondent.

2. Considering the submissions made by the learned counsel for the petitioner as well as the 2nd respondent, this Court is of the view that the delay may be condoned, however, on payment of cost. Accordingly, the delay is condoned on payment of cost of Rs.1,000/- (Rupees One Thousand only) by the petitioner to Mr.Thomas T.Jacob, the learned counsel appearing for the 2nd respondent on or before 27.06.2024. If the cost is paid on or before 27.06.2024 and the affidavit of service is filed, this petition stands allowed and the Registry is directed to number the main appeal and post the matter for admission before this Court on 27.06.2024, if otherwise, in order. If the cost is not paid and the affidavit of service is not filed on or before 27.06.2024, this C.M.P. stands dismissed without any reference to this Court.
