ORDER

Since no adverse Order is passed against the fifth and sixth respondents, notice to them is dispensed with. With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the second respondent to consider the representation of the petitioners dated 05.12.2023 and pass Orders on the same.

3. Heard learned counsel for the petitioners, the learned Government Advocate appearing for the respondents 1 to 3 and the learned Additional Public Prosecutor appearing for the fourth respondent and perused the materials available on record.

4. It is the case of the petitioners that the subject property has been acquired by their grand father of the petitioner, viz, Venugopal Pillai vide registered sale deed dated 26.10.1962. The petitioners are the legal heirs of the daughter of the said Venugopal Pillai and the fifth and sixth respondents are the legal heirs of the son of the said Venugopal Pillai. While so, the fifth and sixth respondents obtained patta for the entire properties left by said Venugopal Pillai as if they are the only legal heirs of their grandfather. In this regard, the petitioners have made a representation to the second respondent and the same has not been considered by the second respondent till date. Hence, the present Writ Petition has been filed.

Considering the limited relief sought for by the petitioners, the second respondent is directed to consider the representation of the petitioners dated 05.12.2023 and pass Orders on the same on merits and in accordance with law, after giving notice to the fifth and six respondents, within a period of the two months from the date of receipt of a copy of this Order.

6. With the above direction, this writ petition is disposed of. No costs. 21.06.2024 vrc 3/5
