..Respondent(s) To direct the 3rd Respondent to consider and pass order on the Petitioners representation dated 22.05.2018 based on the order of the 2nd Respondent by vide his Letter O.Mu.No. A2/1860/2023 dated 06.06.2023 to the 3rd Respondent and also based on the judgment delivered in W.A. Mr.T.Arun Kumar, Addl.G.P. for R1 to R3 Order (Order of the Court was made by S.M.Subramaniam J.) Writ Petition has been instituted seeking direction to 2nd respondents to consider the representation submitted by the writ petitioners on 22.05.2018 and initiate appropriate actions.
2. The claim of the petitioners is that the lands allotted to Depressed Class people are assigned in favour of other community people in violation of the Government policy. The subject lands are exclusively allotted to grant assignment to depressed class people. Therefore, the assignment made in violation of the Government policy is to be reviewed and the authorities have to initiate all appropriate action.
3. The counter filed by the Tahsildar would show that the subject lands have been assigned to the Depressed Class people. However, the depressed class people/ original assignees violated the conditions of the assignment and alienated the government land in favour of other community people. Thus, the alienation became null and void, since it violates the conditions of assignment. The lands allotted to depressed people cannot be transferred or alienated in favour of other community people. That being the case, all further actions are to be initiated.
4. The Tahsildar, Anaikattu would submit that verifications are done and appropriate actions will be initiated to ensure that the assignment of government lands are dealt with in accordance with law and the Government lands will be resumed.
5. In the present case, the lands assigned to other community people in violation of the Government policy is to be dealt with and the authorities are directed to initiate all appropriate actions to ensure that the depressed class lands are allotted to the deserving depressed class people in accordance with the conditions stipulated under the RSO. The Government has to resume the land and appropriate decisions are to be taken either to use the land for public purpose or to reassign to eligible depressed class persons.
