Petition filed under Section 439 of Cr.P.C., seeking to enlarge the petitioner on bail concerned in Crime No.76 of 2021 on the file of the Alandurai Police Station, Coimbatore.

ORDER
The petitioner who was arrested on 10.05.2021 for the offence under Sections 364, 397 and 302 of I.P.C. in Cr.No.76 of 2021 on the file of the respondent police, seeks bail.
2.It is the case of the prosecution that the petitioner borrowed money from the deceased and did not repay the same. When the amount was demanded by the deceased, the petitioner is alleged to have committed murder of the deceased.
3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and that he has been falsely implicated in the case. He further submitted that it is true that there was money transaction inbetween the petitioner and the deceased and further submitted that it does not mean that the petitioner committed the offence. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate (Crl. Side) submitted that it is a murder for gain. He further submitted the petitioner borrowed money from the deceased. When the said money was demanded by the deceased, the petitioner gave sleeping tablets to the deceased, strangulated her, taken her to some other place in an auto and attacked the deceased all over the body and thrown the deceased into a canal.
5.Considering the allegations levelled against the petitioner and the heinous offence committed by the petitioner, I am not inclined to grant bail to the petitioner.
