ORDER

This writ petition was filed to direct the 2nd respondent to get a report from the 3rd respondent as per his order in Na. Ka. A4 / 3773 dated 08.12.2020 and dispose of the same in accordance with law.

2. In this case, the main grievance of the petitioner is with regard to the issuance of patta to the 4th respondent in an illegal manner. In this regard, a representation was also made before the respondent. However, the said representation was not at all considered by the respondent till date. Hence, this petition.

3. In reply, the learned counsel for the respondents would submit that based on the petitioner's representation, the sub-collector had called for information from the Revenue Divisional Officer vide proceedings dated 08.12.2020. Hence, he requests this Court to pass appropriate orders.

4. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.

5. In the case on hand, the main grievance of the petitioner is with regard to the issuance of patta to the 4th respondent. According to the petitioner, the 4th respondent had obtained the patta, pertaining to the subject property, in an illegal manner. Today, it was informed by the respondents that based on the petitioner's representation, the sub-collector had called for information from the Revenue Divisional Officer vide proceedings dated 08.12.2020.

6. On the other hand, issuance of patta to the 4th respondent will no way affect the fundamental rights or the interest of the petitioner. Further, once if such an illegality brought to the knowledge of the concerned official, it is up to them to take appropriate action. If there is any illegality in issuance of patta to the 4th respondent, certainly, suitable action will be taken against the 4th respondent for cancellation of patta and the officials are already in the process of the same based on the petitioner's representation. This Court expects the same will be concluded in a couple of weeks.

7. When such being the case, this Court, sitting in Article 226 of the Constitution of India, is not inclined to issue any direction to the respondents as requested by the petitioner.

8. In view of the above, this writ petition is disposed of accordingly. No cost.
