Respondents Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, calling for the records of the fourth respondent, pertaining to the Electricity Bill No.1443/2002-2003 dated 10.10.2002, relating service connection HT/SC No.340 and quash the same.

ORDER

With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal.

2. Heard Mr.Rathina Asohan, the learned counsel for the petitioner and Mr.A.Tamilvanan, the Government Advocate (Pondy) for the respondents.

3. In this Writ Petition, the petitioner which is a private limited company has challenged the Bill raised on the petitioner for the month of September 2002. During the pendency of the Writ Petition, the petitioner is said to have remitted about Rs.3,00,000/-, which according to the petitioner is over and above, more than the admitted amount of Rs.80,000/- .

4. The learned counsel appearing for the respondents submitted that at present if the petitioner/consumer has any grievance, he has to approach the Consumer Disputes Redressal Forum constituted under Section 42(b) of the Indian Electricity Act.

5. The learned counsel appearing for the petitioner submits that liberty may be granted to the petitioner to approach the said Forum.

Accordingly, the Writ Petition is disposed of, by granting liberty to the petitioner to approach the Consumer Disputes Redressal Forum, by filing an application within a period of of three weeks from the date of receipt of a copy of this order and if it is done, the same shall be dealt with in the manner known to law. It is made clear that any remittance has been made in interregnum, the same shall be subject to the ultimate decision taken by the Forum. No costs.
