This application had been filed seeking to implead the proposed fifth respondent as the fifth defendant in the suit, The Commissioner of Central Excise, No. 690, 3rd Floor, E.V.R.Periyar Maligai, Anna Salai, Nandanam, Chennai - 600 035.

Notice was directed to the proposed fifth respondent/defendant. 3 .

Affidavit of service has been filed indicating that the notice has been served on the said Commissioner of Central Excise. There is no representation either in person or through counsel.

In view of the said fact, the fifth respondent, namely, The Commissioner of Central Excise, No. 690, 3rd Floor, E.V.R.Periyar Maligai, Anna Salai, Nandanam, Chennai - 600 035, is impleaded as fifth defendant in the suit.

The plaintiffs are directed to take suit summons to the fifth defendant, who is now been impleaded after carrying out necessary amendment in the plaint and also after filing amended plaint copy. 6 .

To carry out amendment and to file amended plaint copy issue suit summons, time is granted till 30.11.2017.
