ORDER

The respondent in HMOP.No.85 of 2013 on the file of the Sub Court at Ranipet, is the petitioner in this transfer petition.

2. Heard the learned counsel appearing for the petitioner. None appears for the respondent.

3. The respondent initiated proceedings for divorce against the petitioner in HMOP.No.85 of 2013 before the Sub Court at Ranipet. The

petitioner on receipt of summons filed this transfer petitioner. According to the petitioner, she has filed an application under Domestic Violence Act and the same was taken on file by the learned Judicial Magistrate, Gudiyatham and it was only thereafter, the respondent had filed the matrimonial proceedings before the Sub Court, Ranipet.

4. The petitioner is a permanent resident of Gudiyattam. The petitioner has expressed her difficulties for attending the Court at Ranipet.

5. There is nothing on record to suspect the bonafides in filing the transfer petition. I am therefore of the view that the transfer petition deserves to be allowed.

6. The proceedings in HMOP.No.85 of 2013 is withdrawn from the file of Sub Court, Ranipet and is transferred to the Sub Court, Gudiyattam, for trial and disposal on merits.

The transfer petition is allowed as indicated above. No costs. Consequently, connected miscellaneous petition is closed. 14.09.2016 Index : Yes/No ds
