PRAYER: Tr.C.M.P. filed under Section 24 of C.P.C., to withdraw IDOP No.65 of 2015 on the file of Principal District Judge at Thiruvallur and transfer the same to the file of Subordinate Court, Tirunelveli, Tirunelveli District.

O R D E R

The respondent initiated proceedings in IDOP No.65 of 2015 before the Principal District Court at Thiruvallur. The petitioner, on receipt of summons from the Trial Court and appearing before the said Court, filed this petition for transfer.

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the respondent fairly submitted that the respondent has no objection in transferring the proceedings from Thiruvallur to Tirunelveli.

4. The petitioner is a resident of Tirunelveli. The proceedings is now pending before the Principal District Court at Thiruvallur.

5.In view of the difficulty projected by the petitioner and taking into account the consent given by the respondent, the transfer petition deserves to be allowed.

6. The proceedings in I.D.O.P.No.65 of 2015 is withdrawn from the file of Principal District Court, Thiruvallur and is transferred to the file of Principal District Court, Tirunelveli, for disposal on merits.

7. The Principal District Judge, Tirunelveli is requested to dispose of the proceedings as expeditiously as possible.

8. The Transfer Civil Miscellaneous Petition is allowed as indicated above. No costs. Consequently, connected miscellaneous petition is closed.
