Respondent(s) PRAYER This Criminal Miscellaneous Petition has been filed under Section 438 of Cr.P.C 482 r/w 528 of BNSS, to modify the condition imposed on the petitioner with regard to surrender of passport in Crl Op No.11298 of 2024 dated 03.06.2024 and permit the petitioner to take back the passport which is now in the custody of the Learned Judicial Magistrate-I, Mayiladuthurai in PRC No.20 of 2024 in Crime No.108 of 2024, to visit the cousin sister of the petitioner.

ORDER

This Criminal Miscellaneous Petition has been filed seeking modification in the bail condition that the petitioner was directed to surrender his passport before the trial Court in Crl Op No.11298 of 2024 dated 03.06.2024. 2.The learned counsel for the petitioner submits that the petitioner's relative is ill and taking treatment in Malaysia, and that the petitioner, is a practising Advocate, needs to travel to visit his relative. Accordingly, the learned counsel prays that the condition be modified and the passport be returned to the petitioner.

3.Upon perusal of the petition, it is seen that the petitioner has not stated who is the patient or the purpose for which his presence is required at Malaysia without stating relevant informations, the petitioner seeks modification of the condition. Consequently, I find the petition is devoid of merits and this Criminal Miscellaneous Petition is dismissed.
