ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 09.04.2022 for the offence under Sections 20(a) (i) and 8 (a) of NDPS Act in Crime No.64 of 2022 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner was found in possession of 200 grams of Ganja and also cultivated Ganja plants in his land. The respondent has seized the contraband and arrested the petitioner. Hence, the petition.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and has been falsely implicated in this case. He would further submit that the petitioner is suffering incarceration from 09.04.2022. Hence, he prays for grant of bail to the petitioner.

4.The learned Government Advocate (Crl.Side) for the respondent police would submit that the petitioner is in possession of 200 grams of ganja along with two ganja plants in his land. He would further submit that the respondent awaits for chemical report. The investigation is pending. He vehemently opposed to grant bail to the petitioner.

5.Considering the above facts and circumstances of the case and that the petitioner is in possession of 200 grams of ganja along with two ganja plants in his land and also the investigation is pending, this court is not inclined to grant bail to the petitioner.
