Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, forbearing the second respondent from in any manner acting upon the illegal communication dated 30.08.2016 made by the fourth respondent in his T.E.P.No.51 of 2016, to the second respondent including making the entries in his register pertaining to the properties belonging to the petitioner, as referred as Items 1 and 2 thereto.

ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus to forbear the second respondent from in any manner acting upon the illegal communication dated 30.08.2016 made by the fourth respondent in his T.E.P.No.51 of 2016, to the second respondent including making the entries in his register pertaining to the properties belonging to the petitioner, as referred as Items 1 and 2 thereto.

2. The learned counsel for the petitioner submitted that the second respondent refused to entertain the award submitted by the fourth respondent to be entered in the register. The grievance of the petitioner is that the fourth respondent has made attempts to make entries in the order dated 02.08.2016. Hence, the present Writ Petition. 2/5

The learned Additional Government Pleader appearing for the respondents 1 to 3 referring to the counter affidavit and submitted that the second respondent/Sub-Registrar, vide letter dated 12.08.2016 has returned the award and expressed the inability to file the same in the register and sent the communication to the fourth respondent. Therefore, the prayer sought for does not survive any longer.

4. Recording the said submission made by the learned Additional Government Pleader nothing survives for adjudication and hence no further order is required to be passed.

5. Accordingly, the Writ Petition is dismissed. No costs. Consequently, the connected miscellaneous petitions are closed. 02.11.2022 Speaking Order : Yes/ No Internet: Yes/ No jd 3/5
