ORDER

Vide order dated 12.06.2025 made in Crl.M.P.No.7955 of 2025 in Crl.A.No.382 of 2025, this Court had suspended the substantive sentence of imprisonment imposed on the petitioner on certain conditions. This 1/4

criminal miscellaneous petition has been filed by the petitioner seeking modification of one of those conditions.

Learned counsel for the petitioner submitted that this Court, vide order dated 12.06.2025, while suspending the substantive sentence of imprisonment imposed on the petitioner, imposed certain conditions and one among such conditions is that the petitioner should execute a bond for a sum of Rs.25,000/- with two sureties, each for a like sum, to the satisfaction of the learned Sessions Judge, Mahalir Neethimandram, Allikulam, Chennai. He further submitted that due to his penurious condition, the petitioner is unable to execute a bond for a sum of Rs.25,000/- and as a result, remains in custody. Hence, he submitted that it would suffice, if this Court modifies the condition No.5(a) of the order dated 12.06.2025 and to allow the petitioner to execute a bond for a sum of Rs.10,000/-.

3. Learned Government Advocate (Crl. Side) appearing for the respondent has no objection for the above modification sought by the petitioner.

4. In view of the above and also considering the above submissions made by the learned counsel for the petitioner, this Court is of the considered view that the prayer as sought by the petitioner could be acceded to.

Accordingly, the condition insofar as execution of bond as imposed by this Court in Para No.5(a) of the order dated 12.06.2025 made in Crl.M.P.No.7955 of 2025 in Crl.A.No.382 of 2025 alone stands modified and the petitioner is ordered to be released on bail, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Sessions Judge, Mahalir Neethimandram, Allikulam, Chennai. All other conditions remain unaltered.

6. With the above modification, this criminal miscellaneous petition stands ordered accordingly.
