The learned Counsel for the Appellant seeks to implead the purchasers of the property, as the property was sold by the Defendant in the suit. The Appeal had been preferred by the plaintiff against the dismissal of the suit. Pending Appeal, the Plaintiff had sought interim injunction to protect his possession, based on V.A.O certificate. The same was rejected by this Court as per order dated 11.09.2023. Now, he seeks to implead the purchaser of the property in C.M.P.No.10733 of 2024. Therefore, this petition has become infructuous. The Appellant is within his right to implead the party in the Appeal. The Civil Miscellaneous Petition is dismissed.
