ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.03.2026 for the alleged offences under Sections 7 r/w 8 & 9(a) r/w 10 of POCSO Act, in Crime No.08 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner being a close relative, committed offence against a minor girl aged 17 years. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the complaint is false and motivated due to family dispute and property issue. It is submitted that there was delay in lodging FIR and the victim was living normally even after the alleged occurrence. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that there are serious allegations against the petitioner and the investigation is still pending. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the submission of the learned counsel on either side and considering the seriousness of the allegation and the fact that investigation is pending and Section 183 statement of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is yet to be recorded, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 20-04-2026 NSL
