O R D E R
The present criminal original petition has been filed seeking direction to the third respondent to register the complaint given by the petitioner dated 29.08.2015 and to investigate the same in accordance with law.
2. The petitioner is running a training institute in the name and style of 'Sai ITI'. One Thamizhselvi, the Managing Trustee of Female Development Trust claiming to be working for the downtrodden and several NGO, promised to provide students financially supported by NGO for training and also Government Aid to improve his training Institute. Believing the same, the petitioner had parted her with a total sum of Rs.3,30,000/- on three different occasions. But, subsequently the petitioner
came to know that the said Tamizhselvi had cheated several persons viz.,
(1) Mr.Narasimhan, belonging to Kathili, Pallathur, (2) Bargath, belonging to Thirupathur Kottai Street,
(3) Gunasekaran, Pattani Kolai, Chengam Taluk, Thiruvannamalai District and (4) Muniappan, Mittal Village, Ambur Taluk. When the petitioner approached the said Tamizhselvi and her husband on 28.08.2015, they had threatened the petitioner with dire consequences. Hence, the petitioner has given a complaint. But till date no action was taken. Hence, the present criminal original petition has been filed.
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
4. The learned Additional Public Prosecutor submitted that the complaint was sent only by post and if the petitioner gives a fresh complaint, necessary action will be taken.
5. In view of the submissions made on either side, this Court directs the petitioner to give a fresh complaint to the third respondent within a period of one week from the date of receipt of a copy of this order, and on receipt of the same, the third respondent is directed to conduct enquiry and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law, as early as possible.
6. This criminal original petition is disposed of accordingly.
