O R D E R
The learned counsel for the petitioner would submit that the suit was kept pending without disposal in view of the pendency of a petition filed under Section 10 of Civil Procedure Code, whereas, the appeal filed in A.S.No.183 of 2013 against the main suit itself was dismissed on 03.01.2020. Hence, nothing survives for adjudication in the Interlocutory Application filed 1/3
for stay of suit and there is no impediment to proceed with trial in the present suit. Therefore, the learned counsel for the petitioner seeks for early disposal of the present suit in O.S.No.149 of 2004 within a time frame that may be fixed by this Court.
2. Considering the submissions made by the learned counsel for the petitioner and also considering the long pendency of the suit, a direction is given to the Principal District Munsif, Karaikal, to dispose of the suit in O.S.No.149 of 2004 pending on its file as expeditiously as possible preferably within a period of six months from the date of resumption of physical hearing of the Courts.
With the above lines, the Civil Revision Petition is disposed of. There shall be no order as to costs.
