(The 2nd to 8th respondents are impleaded as per the order made in W.M.P.No.27664 of 2018 dated 18.09.2018 by RMDJ) Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider and pass orders on the petitioner representation dated 11.06.2018 by passing necessary and suitable direction to all the concerned department in the State of Tamil Nadu, to ensure smooth and effective functioning of the petitioner charitable trust, expeditiously in accordance with law.

O R D E R

The petitioner claims to be a Public Charitable Trust. They are running nine different homes in this State apart from three primary schools. The Civil Supplies Department, which was originally supplying Rice and Dhall for inmates, has stopped the said supply on the reason that the petitioner's license to run the homes got expired. However, it is contended by the petitioner that application for renewal has already been sent and the same is pending before the concerned authorities and therefore, during the pendency of the said application for renewal, the Civil Supplies Department cannot stop the supply of Rice and Dhall thereby making the petitioner trust to face severe hardship in feeding the inmates. Therefore, the petitioner approached the respondents 2, 3 and 8 and made a request for restoring the civil supplies, which representation has not been considered so far.

The learned counsel for the petitioner submitted that the petitioner is confining the relief in respect of the home for aged destitutes and nursery and primary schools situated at Somangalam Village alone. Therefore, he contended that the respondents 2, 3 and 8 can consider the grievance of the petitioner and pass appropriate orders.

Considering the above stated facts and circumstances, this Writ Petition is disposed of, by granting liberty to the petitioner to make fresh representation to the respondents 2, 3 and 8 within a period of seven days from the date of receipt of a copy of this order. On receipt of such representation, the respondents 2, 3 and 8 shall consider the same and pass appropriate orders, also by making local inspection with regard

to the number of persons living in each home and pass appropriate orders within a period of two weeks thereafter. No costs.
