ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 379 of IPC in Crime No. 177 of 2022, seek anticipatory bail.
2. The case of the prosecution is that the petitioners were in illegal possession of 40 bags of sand. Hence, the complaint.
3. The learned counsel appearing for the petitioners would submit that the petitioners have been falsely implicated in this case and they have not committed any offence as alleged by the prosecution. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Additional Public Prosecutor would submit that the petitioners were illegally transported 40 bags of sand and both of them are having three previous cases. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the nature of offence committed by the petitioners and taking note of the fact that both of the petitioners are having three previous cases, this Court is not inclined to grant anticipatory bail to the petitioners.
