PRAYER : Writ Petition filed under Article 226 of Constitution of India, for writ of mandamus, directing the first respondent to given an order to register a case and investigate the same in accordance with law by 2nd respondent following the Hon'ble Supreme Court judgment State of Karnataka vs. T.N.Sudhakara Reddy, SLP (Criminal Appeal No.5001 of 2024 arising out of SLP (Criminal No(s).13264 of 2024) by considering the representation of the petitioner dated 04.04.2025, in accordance with law. ORDER
This writ petition has been filed for issuance of writ of mandamus, directing the first respondent to given an order to register a case and investigate the same in accordance with law by the second respondent by considering the representation of the petitioner dated 04.04.2025, in accordance with law.
2.The petitioner sent a complaint on 21.02.2025 to the Sub Inspector of Police, Thittakudi Police Station to take action against one Vasantha, 2/6
Ilavarasan and Sangeetha. One Krishnamurthy, Sub Inspector of Police, not taken any action on the petitioner's complaint. Further he demanded a bribe amount of Rs.5,000/- to initiate action on her complaint. He further confirmed the demand through his mobile phone bearing No.9360761350 calling the petitioner in her mobile No.8110845227 and forced the petitioner to pay the bribe amount. The petitioner paid Rs.1,000/- through Gpay on 22.02.2025 at about 5.14 p.m. and another Rs.500/- in cash in person. After receiving the bribe amount on the petitioner's complaint the said Krishnamurthy double crossed, received the amount from the named person in the complaint and closed the complaint. Hence, the petitioner sent a complaint with the Gpay particulars to the respondent police on 04.04.2025, but the respondent police not taken any action, hence, the above petition. 3.The learned Government Advocate submitted that on the complaint of the petitioner, preliminary enquiry conducted, further mobile number, 3/6
Gpay particulars verified. Hence, action contemplated against Krishnamurthy, Sub Inspector of Police, Thittakudi Police Station. The respondent is reminded that the said Krishnamurthy is a service Sub Inspector of Police, soon to attain superannuation. Considering the same, appropriate steps to be taken.
