Pending second appeal, the contesting first respondent died and the present applications are filed to condone the delay of 2690 days in filing the application to set aside the abatement caused due to the death of the 1st respondent, to set aside the abatement caused due to the death of the 1st respondent and to bring on record the proposed respondents 3 and 4 herein as legal representatives of the deceased 1st respondent. 2.Mr.R.Krishnakumar, learned counsel undertakes to file vakalat of the legal representatives of the deceased first respondent. 3.

Considering the reasons stated out in the affidavit for the delay and the necessity to implead the legal representatives of the deceased 1st respondent being the contesting party, these applications are allowed on condoning the delay of 2690 days in filing the application, to set aside the abatement caused due to the death of the 1st respondent and to bring the legal representatives of the deceased 1st respondent. 29.10.2020 ari Note:Registry is directed to carry out necessary amendment in the second appeal and post the second appeal after four weeks.
