Criminal Original Petition filed under Section 482 of the Criminal Procedure Code praying to direct the respondent to register an FIR on the basis of the petitioner's complaint dated 18.12.2014. For Petitioner : Mr.A,Ramu For Respondent : Mr.M.Maharaja Additional Public Prosecutor

O R D E R

It is submitted by the learned Additional Public Prosecutor, representing the respondent-Police that the petitioner has filed Crl.O.P.No.29995 of 2014, stating that one M.M.Gopi borrwed a sum of Rs.2,00,000/- on 30.10.2012, and gave two cheques towards discharge of the said amount. When the cheques were presented for encashment, they were dishonoured. When the same was informed to the borrowerGopi, he paid Rs.1,00,000/- and balance of Rs.1,00,000/- was not paid. Therefore, case has to be registered against the said Gopi for offence of cheating and that Petition was dismissed by this Court, by order, dated 12.11.2014. The same complaint was given in a different manner on 18.12.2014, and this Petition is filed to register the crime on the basis of the later complaint.

Heard both sides. I have also gone through the order passed by this Court in Crl.O.P.No.29995 of 2014, and it is seen from the said order that the above Petition was filed in respect of the amount advanced by the petitioner to one Gopi on 30.10.2012 and in the present complaint, the petitioner has stated that on 30.10.2012, the said Gopi received Rs.2,00,000/- by giving promise to get employment. https://hcservices.ecourts.gov.in/hcservices/

Therefore, on a perusal of the earlier complaint given by the petitioner, it could be easily inferred that the present complaint is a false one. Hence, the Criminal Original Petition is dismissed. -s/d- Assistant Registrar( ) Dt:16/2/2015 True Copy Sub-Assistant Registrar To 1.
