ORDER
The present writ petition is filed praying for a Writ of Certiorarified Mandamus, calling for the records pertaining to the letter dated 10.07.2019 Vide, Public. Dept. Na.Ka. No. E10 / 018318 / 2019 issued by the 3rd Respondent and quash the same and consequently direct the Respondents to consider the petitioner for suitable employment on compassionate grounds in the office of the 1st Respondent.
2. After submitting for a brief while, the learned Senior Counsel for the petitioner would submit that the State of Tamil Nadu has introduced Tamil Nadu Civil Services (Appointment on Compassionate Grounds) Rules, 2023.
Consequently, the learned Senior Counsel would submit that they be permitted to submit an application placing reliance on the said rules and the same may be considered, without being influenced by the impugned order of rejection.
3. Learned Standing Counsel for the respondent would submit that if any such application is made the same would be considered in accordance with law, and relevance or otherwise of the previous order may be left to the authority to consider while examining the proposed representation/application.
4. While agreeing with the above submission of the respondent, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, it is open to the petitioner to submit a fresh application to the respondent Authority along with documentary evidence. If any such application is submitted by petitioner, the same shall be considered by the appropriate respondents and on its own merits and orders shall be passed in accordance with law, after affording reasonable opportunity of hearing to petitioner and any other interested persons, within a period of eight (8) weeks from the date of such representation.
5. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
